Non-Filers: Missing Tax Returns

The IRS May Have Already Filed for You—and It’s Costing You More Than You Think

If you have skipped filing one or more tax returns, you are not invisible to the IRS. The agency has a system for taxpayers who don’t file, and it almost always works against you. The good news: this is fixable, and acting now can dramatically reduce what you owe.

At Alan Goldstein & Associates, we help individuals and business owners get back into compliance, replace IRS-generated returns with accurate filings, and resolve the tax debt that follows.

The Issue: What Happens When You Don’t File

Failing to file a tax return does not make the obligation disappear. Instead, the IRS takes matters into its own hands.

The Substitute for Return (SFR)

When you fail to file a required return, the IRS has the authority under Internal Revenue Code § 6020(b) to prepare a Substitute for Return (SFR) on your behalf. This is an administrative return the IRS creates using only the information it already has on hand—typically W-2s, 1099s, and other third-party reports from employers, banks, and brokers.

The critical problem: An SFR is calculated without allowing for the standard deductions or credits you are legally entitled to claim. The IRS typically defaults to a Single or Married Filing Separately filing status and applies only the most basic standard deduction—if any.

The SFR does not account for:

  • Standard or itemized deductions (mortgage interest, charitable contributions, state and local taxes)
  • Business expenses for self-employed individuals—the IRS taxes gross 1099 income with no offsets for expenses
  • Tax credits (Child Tax Credit, Earned Income Tax Credit, education credits, dependent care credits)
  • Dependents you supported during the year
  • Correct filing status (Head of Household, Married Filing Jointly)
  • Cost basis for investments or property sales

The result is almost always an inflated tax liability—often far higher than what you would actually owe if you filed your own accurate return.

What Happens Next

After preparing an SFR, the IRS sends a Notice of Deficiency (often called a “90-day letter”) proposing the assessment. You then have 90 days to file your own return or petition the U.S. Tax Court. If you do nothing, the assessment becomes final, and the IRS can begin collection actions—including bank levies, wage garnishment, and federal tax liens.

Even after an SFR has been prepared, it is almost always in your best interest to file your own original return. A correct return can replace the SFR calculation and substantially reduce your liability by claiming the deductions and credits you were entitled to all along.

Why Unfiled Returns Block Your Options

Missing returns also prevent you from accessing most IRS relief programs. Before the IRS will consider an installment agreement, Offer in Compromise, or other collection alternative, all required returns must be filed and up to date. The IRS needs to know the full scope of your liability before agreeing to any long-term resolution—which means filing is the first step toward any real solution.
